NASBA is committed to respecting its Members’ privacy and protecting Members’ nonpublic personal information. In the course of providing our registered Members information, products, and services, we need to collect certain nonpublic personal information about you. This document explains what types of anonymous and personal information we collect, how it is gathered, what we do with it, and how we protect it. This document also describes the terms under which NASBA Members interact with NASBA and use the tools and resources found on the NASBA.com domain (sometimes referred to hereafter as the “Site” or the “NASBA.com site”).


Access to this Site

Access to the NASBA.com website is provided by the North American System Builders Association, Inc. d/b/a “NASBA – The Association of Channel Resellers” (hereinafter “NASBA”) as a service to its registered Members and its Partners and affiliates. This Site is managed by Manageware, LLC, from NASBA’s offices at 72 Perimeter Center East, Suite 7250, Atlanta, Georgia 30346. Your access to and use of this Site and membership in NASBA is conditioned on your acceptance of the terms and conditions set forth in this "Privacy Policy and Terms of Use” document. By using this Site or registering for membership in NASBA, you are acknowledging your agreement to these terms and conditions. If you do not agree to these terms and conditions, do not access this site, download anything from this Site, or otherwise avail yourself of the rights and privileges available to NASBA Members. NASBA makes no representation that this site is appropriate or allowed from any location outside the United States or Canada. If you access this site from outside the United States, you are also responsible for compliance with applicable local laws regarding such access.

These Terms and Conditions are governed and interpreted under the laws of the state of Georgia, United States of America. If any portion of these Terms and Conditions is deemed unlawful, void or unenforceable, then that part shall be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms and Conditions set forth the entire understanding and agreement between you and NASBA with respect to the subjects discussed below.


Anonymous Information We Collect and How We Use It

Cookies
Like many other web sites, the NASBA.com site uses cookies to improve your experience with our online content. For example, we may use a cookie to track the number of visits by page and link, and average time spent in different areas of our site, to improve the content and usage of our site. Cookies also help us identify members so they don't have to re-enter a user id and password when they wish to download a utility or information, access Member’s-only portions of the site, or post to a discussion. Similarly, cookies can be used to control the number of times you see marketing material or pop-up surveys. By allowing us to better understand how users interact with the site over time, cookies also help us deliver more relevant content to you. Cookies may be created directly by the NASBA.com site for these purposes, or by third-party companies operating on our behalf. Some NASBA Partners may occasionally serve you cookies as well. We do not have control over cookies placed by third-parties. You need not have cookies turned on to visit our site, though cookies may be required in order for you to access certain areas of our site.

Aggregated Information, Statistical Reports and Analysis
Naturally, NASBA makes use of and shares with third-parties the aggregate demographic information, site usage statistics, or statistics and data that describe our Members or online audience. These statistics, aggregated data, and/or the analytic conclusions drawn from that data, are often based on the information you and other Members provide when interacting with NASBA. This information may be collected when you register for specific programs, participate in online surveys, purchase or contract for products or services offered by or through NASBA, qualify yourself for or participate in Channel Programs administered by NASBA or its Sponsor Partners, browse our site, or otherwise share information with us or our third-party Partners. The aggregated information we share under these circumstances helps our partners understand the current complexion of the market and the general attributes and make-up of the NASBA Membership. This information does not include identifying information about any individual Member or site visitor, unless the individual has given us permission to share that information.

Personally Identifiable Nonpublic Information We Collect and How We Use It

We also collect personally identifiable information when you provide it to us, such as when you enroll as a NASBA Member, subscribe to a NASBA-affiliated email newsletters, complete hard-copy forms at trade shows, register online or offline to participate in Channel-related programs, participate in seminars, focus groups, or NASBA “city dinners,” fill-out surveys, or otherwise communicate with us. We may also receive information about you from other sources and add it to the information you have provided to us.

The types of information we collect generally fall within two distinct categories: (1) names, phone and fax numbers, postal and email addresses, or other similar types of information that shall hereinafter be referred to as “Contact Information,” and (2) individualized data regarding you or your business, including, but not limited to, the number and type of technology hardware products you assemble or manufacture, the solutions or services you provide, annual revenue, markets you focus on, channels you sell through, your purchasing patterns, the number of employees in your company, and any information, other than Contact Information, that relates specifically to the behavior or actions of you or your company. We refer to this second type of information as “Member Profile Information.” As explained more specifically below, NASBA does not share Member Profile Information without your permission.

As a NASBA Member, we encourage you to view, update, correct or change your Member Profile Information at any time via your Member Profile page. Your periodic updating of this information allows us to tailor programs to your unique circumstances and interests. To view or change your profile, please follow the link:

NASBA respects the privilege of being entrusted with your Member Profile Information, and will not share this information with third-party companies unless you have authorized the disclosure.

In certain circumstances, you will be given the opportunity to register for specific programs that may require, as a condition of participation in the program, that you disclose certain information to a third-party program sponsor or afilliate that could include portions of your Member Profile Information. That information may be pre-populated in an online registration form if you choose to register for such a program, but you will have the ability to decide whether to disclose that information to the third-party at the time you decide either to register for such a program, or to decline to participate. If you choose to register for such a program, you are granting us permission to pass the collected information to that service or site Partner.

If you choose to disclose personally identifiable information to a third-party through links or other portions of the NASBA.com website, the third-party’s use of that information is subject to its privacy policies and NASBA is not responsible for the third-party’s use of the information.

Contact Information
NASBA will use your Contact Information to communicate with you in a variety of ways. As a NASBA Member, you can, for example, expect to receive relevant email, direct mail, and other forms of communication that relate to industry news, legislation, channel trends, specially-negotiated “Members Only” discounts and promotions, information pertaining to our Partners’ Channel Programs, surveys, and a variety of other products and services of interest to the NASBA Membership. Some areas of the NASBA website also utilize automatic email notifications or confirmations, which are independent of any regular or semi-regular series of e-newsletters or emails. With the exception of these automatic notifications and confirmations, you have the option to “Unsubscribe” from any of these series of e-newsletters or emails. Any email you receive from NASBA will always include an "Unsubscribe" option.

NASBA reserves the right, however, to cancel your NASBA Membership and deny you access to the Member-Only portions of the NASBA.com site if you unsubscribe from or otherwise decline to receive any and all communications from NASBA.

NASBA does not sell mailing lists or provide third-parties with general access to your Contact Information. NASBA does, however, reserve the right to share your Contact Information, on a limited basis, with NASBA Partners or other prudently screened third-party companies. We reserve the right to do so, in carefully limited circumstances, in order to provide you with a broader range of products and services, improve your experience with us, and better serve your needs by leveraging the buying power of NASBA as a large association. If NASBA chooses to use Contact Information in this manner, NASBA will carefully review any such mailing before it is sent and monitor the limited use of Contact Information to ensure that it is used only for the approved purpose, but NASBA is not responsible for third-party use of this information. As explained above, NASBA does not disclose your confidential Member Profile Information without your consent.

NASBA also allows certain third party companies who provide specialized services, such as email message deployment, merge-purge (identifying and removing duplicate addresses) of lists, postal mailing, customer service and research, statistical analysis, and other data processing, to access the Contact Information and Member Profile Information specifically in connection with providing services to NASBA. These companies work on our behalf and we do not provide our lists or other data to them for their own, permanent use.

Links on NASBA.com website will enable you to leave the site to visit other sites not under the control of, or reviewed by, NASBA. NASBA is not responsible for the contents of any linked site or any site linked to a linked site. NASBA provides links to other sites as a convenience. Your linking to any off-site pages is at your own risk. These other websites, accessible through the NASBA.com website, also have their own privacy policies and data collection practices. Please consult each site's privacy policy. NASBA is not responsible for the actions of third parties.


Security

We use reasonable precautions to keep the personal information you disclose through our website secure. For example, NASBA.com uses secure servers to protect your personal information using advanced encryption and firewall technology. However, by using our site you agree that we are not responsible for any breach of security or for the actions of third parties.
